Performance of a contract with you: Where we need to perform the contract we are about to enter into or have entered into with you.

Legitimate interests: We may use your personal data where it is necessary to conduct our business and pursue our legitimate interests, for example to prevent fraud and enable us to give you the best and most secure customer experience. We make sure we consider and balance any potential impact on you and your rights (both positive and negative) before we process your personal data for our legitimate interests. 5.1 We store Gift Aid declarations and related personal data securely for up to 6 years, in line with HMRC guidelines.

5.2 We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

5.3 We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Under the UK General Data Protection Regulation (UK GDPR), you have the right to:

Prohibited content

You must not upload, post or transmit to or via the Platform any material that:

• Is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable.
• Promotes sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
• Infringes any patent, trademark, trade secret, copyright or other intellectual property or other rights of any other person.
• Violates the legal rights (including the rights of publicity and privacy) of others or contains any material that could give rise to any civil or criminal liability under applicable laws or regulations.
• Promotes any illegal activity or conduct that is abusive, threatening, obscene, defamatory or libellous.
• Promotes illegal drugs, violence, or any illegal activity.
• Is commercially exploitative such as unsolicited bulk e-mail, "spam," or attempts to create traffic for commercial websites.
• Contains any viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines that may damage the Platform.
• May cause annoyance, inconvenience or needless anxiety to others.

Illegal content

In addition, you must not use the Platform in any way that involves the following:

• Terrorism.
• Child sexual exploitation or abuse including grooming and child sexual abuse material.
• Hate offences.
• Harassment, stalking, making threats or abuse.
• Controlling or coercive behaviour.
• Intimate image abuse.
• Extreme pornography.
• Sexual exploitation of adults.
• Human trafficking.
• Unlawful immigration.
• Fraud and financial offences.
• Proceeds of crime offences.
• Drugs or psychoactive substance offences.
• Firearms, knives and other weapons offences.
• Encouraging or assisting suicide.
• Foreign interference offences.
• Animal cruelty.

Content very harmful to children

The following must not be uploaded, shared or generated directly on the Platform:

• Pornographic content.
• Content which encourages, promotes or provides instructions for suicide.
• Content which encourages, promotes or provides instructions for an act of deliberate self-injury.
• Content which encourages, promotes or provides instructions for an eating disorder or behaviours associated with an eating disorder.

Other content harmful to children

You must not upload, post, create on the Platform or share any of the following:

• Content that is abusive and which targets any of the following characteristics: race, religion, sex, sexual orientation, disability, gender reassignment.
• Content which incites hatred against people:
• of a particular race (including colour, nationality, and ethnic or national origins, religion (including lack of religion), sex or sexual orientation;
• who have a physical or mental disability; or
• who have the characteristic of gender reassignment (meaning the person is proposing to undergo, is undergoing or has undergone a process (or part of a process) for the purpose of reassigning the person's sex by changing physiological or other attributes of sex).
• Content which encourages, promotes or provides instructions for an act of serious violence against a person.
• Bullying content.
• Content which:
• depicts real or realistic serious violence against a person (real or not);
• depicts the real or realistic serious injury of a person (real or not) in graphic detail.
• Content which:
• depicts real or realistic serious violence against an animal (real or not);
• depicts the real or realistic serious injury of an animal (real or not) in graphic detail;
• realistically depicts serious violence against a fictional creature or the serious injury of a fictional creature in graphic detail.

Communications offences

You must not upload, post, create on the Platform or share content containing any of the following:

• A false message knowing it to be false, intending to cause non-trivial psychological or physical harm to a likely audience, and with no reasonable excuse.
• A message threatening death or serious harm while intending or being reckless as to whether the object of the threat would fear that the threat would be carried out.
• Flashing images when it is reasonably foreseeable that an individual with epilepsy will see it and the sender intended that the individual would suffer harm and the sender has no reasonable excuse for sending the images.
• A communication that intends to encourage serious self-harm.
• An unsolicited sexual image, including a manufactured intimate image or "deepfake" intending the recipient to be caused alarm, distress or humiliation, or for the purpose of sexual gratification and being reckless as to whether the recipient will be caused alarm, distress or humiliation.
• A sexually explicit deepfake.

Additional provisions for video content

You must comply with our guidance on use of maturity or sensitivity ratings on video content.

For the avoidance of doubt, for any User Content in the form of video content:

• You must tell Swing2Good immediately, if you upload a video containing any of the following: criminal material (relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia), unclassified or unclassifiable videos, videos rated R18 or suitable for R18 rating and other material that might impair the physical, mental or moral development of persons under the age of 18 (restricted material).
• You must not upload a video containing material likely to incite violence or hatred against a group of persons or a member of a group of persons based on any of the following grounds: sex, race, colour, ethnic or social origin, genetic features, language, religion or other belief, political opinion, membership of a national minority, property, birth, disability, age or sexual orientation.

Advertising

You must not upload, post, create on the Platform or share content containing any advertising or promoting any services or web links to other sites.

You must not upload a video containing advertising for any of the following:

• Cigarettes and other tobacco products, electronic cigarettes or electronic cigarette refill containers, and prescription-only medicine; or
• Alcoholic drinks that are not aimed specifically at under 18s and do not encourage immoderate consumption of alcohol.

Any advertising included in a video you upload must not:

• Prejudice respect for human dignity.
• Include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation.
• Encourage behaviour prejudicial to health or safety.
• Encourage behaviour grossly prejudicial to the protection of the environment.
• Cause physical, mental or moral detriment to persons under the age of 18.
• Directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity.
• Directly encourage such persons to persuade their parents or others to purchase or rent goods or services.
• Exploit the trust of such persons in parents, teachers or others.
• Unreasonably show such persons in dangerous situations.

You must use the functionality provided on the Platform to declare whether, as far as you know or can reasonably be expected to know, any video contains advertising.

These Terms of Use govern your use of the Swing2Good website (the "Platform"). By accessing or using our Platform, you agree to comply with and be bound by these terms.

Swing2Good reserves the right to make changes to the Platform from time to time to reflect changes to its offers, user's needs and business priorities. It is your responsibility to ensure that the Platform is accessible.

Swing2Good may withdraw or suspend the Platform at any time. The Platform is available free of charge. Swing2Good does not guarantee that the Platform, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Platform for business or operational reasons.

Swing2Good may transfer its rights and obligations under these terms to another organisation. This will not affect your rights under these terms.

The Platform is only available to users in England and Wales.

1. About Swing2Good

1.1 Swing2Good provides a platform for golf captains, charity organisers, and supporters to raise and track donations for UK-registered charities.

1.2 We aim to make charitable fundraising through golf more accessible, transparent, and effective.

2. Donations

2.1 All donations made through the Swing2Good platform are processed via third-party providers (e.g. Stripe).

2.2 Donations are non-refundable, except where required by applicable law.

2.3 Donations made through the Swing2Good platform are processed securely via our third-party payment provider, Stripe. Once processed, funds are transferred to Swing2Good's designated business account, where they are held temporarily before being disbursed to the chosen charity or fundraising beneficiary. Swing2Good acts as an intermediary in this process and ensures that funds are managed securely and transferred in full (less applicable payment processing fees) to the intended recipient within a reasonable timeframe. Swing2Good does not use any donation funds for operational purposes and does not claim ownership over funds intended for charitable causes. All transfers are logged and auditable, and we are committed to ensuring that donations are passed on promptly and in accordance with our fundraising policies.

3. Gift Aid

3.1 If you are a UK taxpayer, you may be eligible to apply Gift Aid to your donation.

3.2 You confirm that any information you provide for Gift Aid purposes is accurate and complete.

3.3 Swing2Good may:

• Act as a facilitator or Gift Aid agent on behalf of charities, or
• Transfer your declaration directly to the selected charity to process the claim with HMRC.

Note: Only eligible charities can reclaim Gift Aid.

4. Platform Usage

4.1 You agree to use the Swing2Good platform in a lawful and responsible manner.

You must not:

• Use the Platform for unlawful purposes or to breach any applicable laws.
• Provide false, misleading, or inaccurate information.
• Upload or share any offensive, harmful, defamatory, or fraudulent content.

4.2 We reserve the right to suspend or remove access to anyone found misusing the platform.

4.3 You must keep any account details safe. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of Swing2Good's security procedures, you must treat such information as confidential. You must not disclose this information to any third party.

4.4 Swing2Good reserves the right to disable any user identification code, password, whether chosen by you or allocated by Swing2Good, at any time, if in Swing2Good's reasonable opinion you have failed to comply with any of the provisions of these terms of use.

4.5 If you know or suspect that anyone other than you knows your user identification code or password, you must notify us at info@swing2good.co.uk.

5. Intellectual Property

5.1 All content, branding, design, and materials featured on the Swing2Good platform are the intellectual property of Swing2Good or its partners and all rights to such intellectual property are reserved.

5.2 You may not copy, reproduce, distribute, or use any content without our prior written consent.

5.3 If you do not comply with 5.2, then Swing2Good reserves the right to cease your use of the Platform immediately and you must return or destroy any copies of the materials you have made (except where permitted by Swing2Good).

6. Uploading content to our site

6.1 Whenever you make use of a feature that allows you to create content directly on the Platform, upload or share content to the Platform, or to make contact with other users of the Platform, you must comply with the standards set out in our Acceptable Use Policy.

6.2 You warrant that any such contribution complies with those standards, and you are liable to Swing2Good and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage Swing2Good suffers as a result of your breach of warranty.

6.3 Swing2Good will consider any content you upload to the Platform to be non-confidential and not protected by any trade mark, patent or copyright ("non-proprietary"), that is, in the public domain. You own your content, but you are required to grant Swing2Good a limited licence to use, store and copy that content and to distribute and make it available to others.

6.4 Swing2Good also has the right to disclose your identity to anyone who is claiming that any content posted or uploaded by you to the Platform violates their intellectual property rights or their right to privacy.

6.5 Swing2Good has the right to remove any posting you make on the Platform if, in Swing2Good's opinion, your post does not comply with the acceptable use standards set out in our Acceptable Use Policy.

Rights you are giving Swing2Good to use material you upload

6.7 When you upload or post content to the Platform, you grant Swing2Good the following rights to use that content:

• A worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the website and across different media including to promote the Platform or the service to expire when the user deletes the content from the Platform.
• A worldwide, non-exclusive, royalty-free, transferable licence for other users, partners or advertisers to use the content in accordance with the functionality of the Platform to expire when the user deletes the content from the Platform.

User-generated content is not approved by Swing2Good.

6.8 The Platform may include information and materials uploaded by other users. This information and these materials have not been verified or approved by Swing2Good. The views expressed by other users on the Platform do not represent Swing2Good's views or values.

• How recipient charities use the donated funds.
• Any indirect, incidental, or consequential losses arising from use of the Platform.

7.2 Our maximum liability to you is limited to the amount of your most recent donation made through the platform.

7.3 Do not rely on information on this Platform. The content on the Platform is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Platform.

Swing2Good Partnership Terms and Conditions

Effective Date: 01st June 2025

These Terms and Conditions govern the purchase and display of a Partner Listing by businesses ("you", "your", "Partner") on the Swing2Good website ("we", "us", "our", "Swing2Good").

1. Partnership Listing Overview

1.1 Swing2Good offers promotional listings on its Platform at a rate of £100 + VAT per year, payable in full in advance.

1.2 Swing2Good reserves the right to increase the promotional listing price on an annual basis with effect from each anniversary of the original promotional listing.

1.3 Each listing includes:

• Your business name and logo/image
• Contact details
• A short description or promotional offer
• A link to your external website, social media, or booking page (as provided by you)

2. Term and Renewal

2.1 Listings are valid for 12 months from the date payment is received and confirmed.

2.2 You will be notified before expiry with the option to renew for another 12-month term at the current rate or at the renewed rate as per 1.2.

3. Payment

3.1 Payment of £100 + VAT must be made in full before the listing goes live.

3.2 Payments are processed securely via:

• Our invoicing system, or
• Approved third-party platforms (e.g. Stripe or direct bank transfer)

4. Content and Approval

4.1 You are responsible for providing all:

• Text (e.g. business description or offer)
• Images or logos
• Links to websites or booking platforms

4.2 Swing2Good reserves the right to:

• Review all submitted content before publication
• Refuse or remove any listing that is misleading, offensive, inappropriate, or not aligned with Swing2Good's Terms of Use Policy [INSERT LINK]

5. Use of Your Branding

5.1 By submitting a listing, you grant Swing2Good the right to:

• Display your business name, image, and description on the Platform
• Feature your listing in Swing2Good promotional materials, including newsletters and social media, for the duration of the partnership

6. Cancellations and Refunds

6.1 You may cancel your listing at any time; however, no refunds will be issued once the listing is published.

6.2 If Swing2Good removes your listing due to a breach of these terms, no refund will be provided.

7. Limitation of Liability

7.1 Swing2Good does not guarantee:

• Specific levels of traffic to your listing
• Leads, conversions, or increased business revenue

7.2 Swing2Good is not liable for any:

• Loss of business or income resulting from listing performance
• Loss of profit, consequential losses or otherwise
• Technical issues affecting platform availability

7.3 Our total liability under these terms is limited to the amount you paid for your listing.

8. Modifications

8.1 Swing2Good reserves the right to update these Terms and Conditions from time to time.

8.2 You will be notified of any significant changes affecting your current listing.

8.3 Swing2Good may make minor edits to your listing to improve formatting or clarity without prior notice.
