For A Golf Day

These Terms and Conditions apply to golf club Captains and charity Golf Day organisers ("you") who create fundraising pages on the Swing2Good platform. By creating a page, you agree to the following terms:

1. Eligibility

1.1 You must be authorised to raise funds on behalf of your chosen charity.

1.2 The charity must be a UK-registered charity.

2. Donation Structure

2.1 Captains

a. If you choose your own registered charity:

- 95% of the funds raised will be directed to your chosen charity.

- 5% will go to Swing2Good's Charity of the Year.

b. If you choose to support the Charity of the Year directly:

- 100% of the donations will go to that charity.

2.2 Golf Days

a. If you are setting up a fundraising page as part of a golf day:

- 100% of the donations will go to your nominated charity.

2.3 Note:

Donation percentages refer to funds after deduction of third-party payment processing fees.

Swing2Good works with Stripe, which charges a fee of 1.5% – 20p per transaction.

2.4 Fund Handling

Donations made via the Swing2Good platform are first processed securely by our payment provider, Stripe. Following this, funds are transferred to Swing2Good's designated business bank account, where they are held temporarily before being disbursed to the nominated charity. Swing2Good does not retain any portion of the donations and is committed to passing on donations (after payment processing fees and agreed allocations) promptly and transparently.

3. Gift Aid

3.1 If donors are UK taxpayers and opt into Gift Aid, the relevant declaration will be collected during the donation process.

3.2 Gift Aid reclaimed by the charity may:

a. Be split in the same proportion as the donation (e.g., 95/5), or

b. Be passed entirely to the nominated charity, depending on the charity's preference.

3.3 Swing2Good facilitates the collection of Gift Aid declarations but does not guarantee Gift Aid recovery.

3.4 Only eligible charities are able to reclaim Gift Aid from HMRC.

4. Responsibilities

By creating a fundraising page, you confirm that:

4.1 You are acting in good faith to raise funds for charitable purposes.

4.2 You will not misrepresent the use or purpose of the donations.

4.3 You will not offer goods or services in exchange for donations unless pre-agreed with Swing2Good and the charity.

5. Platform Usage and Conduct

5.1 You may use Swing2Good branding and tools provided to promote your fundraising efforts.

5.2 You agree not to use the platform in any way that is:

a. Illegal

b. Misleading

c. Damaging to the reputation of Swing2Good or any participating charities.

6. Amendments and Closure

6.1 Swing2Good reserves the right to:

a. Close or suspend any fundraising page, or

b. Request edits to any content if it breaches these terms or conflicts with platform guidelines.

6.2 Swing2Good may update these Terms periodically. Continued use of the platform constitutes acceptance of any changes.

2.3 Donations made through the Swing2Good platform are processed securely via our third-party payment provider, Stripe. Once processed, funds are transferred to Swing2Good's designated business account, where they are held temporarily before being disbursed to the chosen charity or fundraising beneficiary. Swing2Good acts as an intermediary in this process and ensures that funds are managed securely and transferred in full (less applicable payment processing fees) to the intended recipient within a reasonable timeframe. Swing2Good does not use any donation funds for operational purposes and does not claim ownership over funds intended for charitable causes. All transfers are logged and auditable, and we are committed to ensuring that donations are passed on promptly and in accordance with our fundraising policies.

3. Gift Aid

3.1 If you are a UK taxpayer, you may be eligible to apply Gift Aid to your donation.

3.2 You confirm that any information you provide for Gift Aid purposes is accurate and complete.

3.3 Swing2Good may:

• Act as a facilitator or Gift Aid agent on behalf of charities, or
• Transfer your declaration directly to the selected charity to process the claim with HMRC.

Note: Only eligible charities can reclaim Gift Aid.

4. Platform Usage

4.1 You agree to use the Swing2Good platform in a lawful and responsible manner.

You must not:

• Use the Platform for unlawful purposes or to breach any applicable laws.
• Provide false, misleading, or inaccurate information.
• Upload or share any offensive, harmful, defamatory, or fraudulent content.

4.2 We reserve the right to suspend or remove access to anyone found misusing the platform.

4.3 You must keep any account details safe. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of Swing2Good's security procedures, you must treat such information as confidential. You must not disclose this information to any third party.

4.4 Swing2Good reserves the right to disable any user identification code, password, whether chosen by you or allocated by Swing2Good, at any time, if in Swing2Good's reasonable opinion you have failed to comply with any of the provisions of these terms of use.

4.5 If you know or suspect that anyone other than you knows your user identification code or password, you must notify us at info@swing2good.co.uk.

5. Intellectual Property

5.3 If you do not comply with 5.2, then Swing2Good reserves the right to cease your use of the Platform immediately and you must return or destroy any copies of the materials you have made (except where permitted by Swing2Good).

6.1 Whenever you make use of a feature that allows you to create content directly on the Platform, upload or share content to the Platform, or to make contact with other users of the Platform, you must comply with the standards set out in our Acceptable Use Policy.

6.2 You warrant that any such contribution complies with those standards, and you are liable to Swing2Good and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage Swing2Good suffers as a result of your breach of warranty.

6.3 Swing2Good will consider any content you upload to the Platform to be non-confidential and not protected by any trade mark, patent or copyright ("non-proprietary"), that is, in the public domain. You own your content, but you are required to grant Swing2Good a limited licence to use, store and copy that content and to distribute and make it available to others.

6.4 Swing2Good also has the right to disclose your identity to anyone who is claiming that any content posted or uploaded by you to the Platform violates their intellectual property rights or their right to privacy.

6.5 Swing2Good has the right to remove any posting you make on the Platform if, in Swing2Good's opinion, your post does not comply with the acceptable use standards set out in our Acceptable Use Policy.

Rights you are giving Swing2Good to use material you upload

6.7 When you upload or post content to the Platform, you grant Swing2Good the following rights to use that content:

• A worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the website and across different media including to promote the Platform or the service to expire when the user deletes the content from the Platform.
• A worldwide, non-exclusive, royalty-free, transferable licence for other users, partners or advertisers to use the content in accordance with the functionality of the Platform to expire when the user deletes the content from the Platform.

User-generated content is not approved by Swing2Good.

You must not introduce viruses

• How recipient charities use the donated funds.
• Any indirect, incidental, or consequential losses arising from use of the Platform.

User Content:

• Must comply with the law applicable in any country from which it is posted and to which the website is targeted.

User Content must not:

• Be obscene, offensive, hateful or inflammatory.
• Infringe any copyright, database right or trade mark of any other person.
• Include video content that has been or would be likely to be given an R18 certificate by the British Board of Film Classification (BBFC).

• Include material that might impair the physical, mental or moral development of persons under the age of 18.
• Be likely to deceive any person.

• Contain illegal content or promote any illegal content or activity.
• Be in contempt of court.
• Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.

• Impersonate any person or misrepresent your identity or affiliation with any person.

• Proceeds of crime offences.
• Drugs or psychoactive substance offences.
• Firearms, knives and other weapons offences.
• Encouraging or assisting suicide.
• Foreign interference offences.
• Animal cruelty.

Content very harmful to children

The following must not be uploaded, shared or generated directly on the Platform:

• Pornographic content.
• Content which encourages, promotes or provides instructions for suicide.
• Content which encourages, promotes or provides instructions for an act of deliberate self-injury.
• Content which encourages, promotes or provides instructions for an eating disorder or behaviours associated with an eating disorder.

Other content harmful to children

You must not upload, post, create on the Platform or share any of the following:

• Content that is abusive and which targets any of the following characteristics: race, religion, sex, sexual orientation, disability, gender reassignment.
• Content which incites hatred against people:
• of a particular race (including colour, nationality, and ethnic or national origins, religion (including lack of religion), sex or sexual orientation;
• who have a physical or mental disability; or
• who have the characteristic of gender reassignment (meaning the person is proposing to undergo, is undergoing or has undergone a process (or part of a process) for the purpose of reassigning the person's sex by changing physiological or other attributes of sex).
• Content which encourages, promotes or provides instructions for an act of serious violence against a person.
• Bullying content.
• Content which:
• depicts real or realistic serious violence against a person (real or not);
• depicts the real or realistic serious injury of a person (real or not) in graphic detail.
• Content which:
• depicts real or realistic serious violence against an animal (real or not);
• depicts the real or realistic serious injury of an animal (real or not) in graphic detail;
• realistically depicts serious violence against a fictional creature or the serious injury of a fictional creature in graphic detail.
• Content which encourages, promotes or provides instructions for a challenge or stunt highly likely to result in serious injury to the person who does it or to someone else.
• Content which encourages a person to ingest, inject, inhale or in any other way self-administer:
• a physically harmful substance;
• a substance in such a quantity as to be physically harmful.

Offences

You must not upload, post, create on the Platform, share or cause any uploading, posting, creation or sharing, of any of the following:

• A grossly offensive, indecent, obscene or menacing message intending to cause offence, menace, distress or anxiety.
• A false message knowing it to be false, intending to cause non-trivial psychological or physical harm to a likely audience, and with no reasonable excuse.
• A message threatening death or serious harm while intending or being reckless as to whether the object of the threat would fear that the threat would be carried out.
• Flashing images when it is reasonably foreseeable that an individual with epilepsy will see it and the sender intended that the individual would suffer harm and the sender has no reasonable excuse for sending the images.
• A communication that intends to encourage serious self-harm.
• An unsolicited sexual image, including a manufactured intimate image or "deepfake" intending the recipient to be caused alarm, distress or humiliation, or for the purpose of sexual gratification and being reckless as to whether the recipient will be caused alarm, distress or humiliation.
• A sexually explicit deepfake.

Additional provisions for video content

You must comply with our guidance on use of maturity or sensitivity ratings on video content.

For the avoidance of doubt, for any User Content in the form of video content:

• You must tell Swing2Good immediately, if you upload a video containing any of the following: criminal material (relating to terrorism, sexual exploitation of children, child pornography, racism and xenophobia), unclassified or unclassifiable videos, videos rated R18 or suitable for R18 rating and other material that might impair the physical, mental or moral development of persons under the age of 18 (restricted material).
• You must not upload a video containing material likely to incite violence or hatred against a group of persons or a member of a group of persons based on any of the following grounds: sex, race, colour, ethnic or social origin, genetic features, language, religion or other belief, political opinion, membership of a national minority, property, birth, disability, age or sexual orientation.

Advertising

You must not upload, post, create on the Platform or share content containing any advertising or promoting any services or web links to other sites.

You must not upload a video containing advertising for any of the following:

• Cigarettes and other tobacco products, electronic cigarettes or electronic cigarette refill containers, and prescription-only medicine; or
• Alcoholic drinks that are not aimed specifically at under 18s and do not encourage immoderate consumption of alcohol.

Any advertising included in a video you upload must not:

• Prejudice respect for human dignity.
• Include or promote discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age or sexual orientation.
• Encourage behaviour prejudicial to health or safety.
• Encourage behaviour grossly prejudicial to the protection of the environment.
• Cause physical, mental or moral detriment to persons under the age of 18.
• Directly exhort such persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity.
• Directly encourage such persons to persuade their parents or others to purchase or rent goods or services.
• Exploit the trust of such persons in parents, teachers or others.
• Unreasonably show such persons in dangerous situations.

You must use the functionality provided on the Platform to declare whether, as far as you know or can reasonably be expected to know, any video contains advertising.
